Whereas the draft of the
following rules further to amend the Contract Labour (Regulation and Abolition)
(Karnataka) Rules, 1974 was published as required by sub-section (1) of the
section 35 of the Contract Labour (Regulation and Abolition) (Karnataka) Act,
1970(Central Act 37 of 1970) in Notification - VI No. LD 16 KABINI 2001, dated
28th December 2001 in Part IVA of the Karnataka Gazette Extra ordinary dated
4th January 2002, inviting objections and suggestions from all persons likely
to be affected thereby within thirty days from the date of its publication in
the Official Gazette.
Whereas, the said
Gazette was made available to the public on 4-1-2002.
And whereas, no
objections and suggestions have been received by the State Government.
Now, therefore, in
exercise of the powers conferred by section 35 of the Contract Labour
(Regulation and Abolition) (Karnataka) Act, 1970 (Central Act 37 of 1970) the
Government of Karnataka hereby makes the following rules namely:-

Title and commencement:-
(1) These rules may be called the Contract Labour (Regulation and Abolition)
(Karnataka Amendment) Rules, 2002.
(2) They shall come into force from the date of their publication in the
Official Gazette. |

Amendment of Rule 78:-
In rule 78 of the Contract Labour (Regulation and Abolition) (Karnataka) Rules,
1974 (hereinafter referred to as the said rules), in rule (1), in clause (d),
after the words, figures and brackets "Minimum Wages Act, 1948 (Central Act 11
of 1948), or the rules made there under" the words, figures and brackets "or
the Factories Act, 1948 (Central Act LXIII of 198/48) in the rules made there
under" shall be inserted. |

Amendment of Rule 82:-
In rule 82 of the said rules, in sub-rule (2), the following proviso shall be
inserted, namely:-
"Provided that no annual returns shall be submitted by an employer, if he
submits a common annual return in form 20 of the Karnataka Factories Rules,
1969'.
