In exercise of the powers conferred by section 54 of the Air (Prevention and Control of Pollution) Act, 1981 (Central Act 14 of 1981) the Government of Karnataka, after consultation with the Karnataka State Pollution Control Board, hereby makes the following rules further to amend the Karnataka Air (Prevention and Control of Pollution) Rules, 1983, namely:-

1.

Title and Commencement:-
(1) These Rules may be called the Karnataka Air Prevention and Control of Pollution (Amendment ) Rules 2002.

(2) They shall come into force from the date of their Publication in the Official Gazette.
2. Substitution of Form XIII:-
For form I of the Karnataka Air (Prevention and Control of Pollution) Rules, 1983, the following shall be substituted, namely:-

1. I/we declare that the above furnished information is true and correct to the best of my/our knowledge. I/we am/are aware that furnishing any wrong information is punishable under Section 42(f) of Water (Prevention & Control of Pollution) Act 1974 and Section 38(f) Air (Prevention & Control of Pollution) Act 1981.
2. I/we hereby submit that as required under Section 25 of water (Prevention & Control of Pollution) Act 1974 and Section 21 of Air (Prevention & Control of Pollution) Act 1981 in case of change either of point of discharge or the quantity or quality of the discharge, fresh application for consent for establishment shall be made & until such consent is granted, no change shall be made in the point of discharge or the quantity or quality of the effluents/emission. I/we am/are aware that the violations of section 25 of Water Act, Section 21 of Air Act attracts penal provisions under the relevant provisions of Water and Air Act.
3. I/we herewith submit an affidavit on the basis of which consent for establishment will be issued to me/us and I/we will be held responsible under Section 45(A) of Water Act and/or section 39 of Air Act for any mis/wrong representation.

Note: If the application and check list are complete in all respect, application will be cleared within 21 days. If not completed, application will not be accepted. Compensation will be paid at the rate of Rs. 50/- (Rupees Fifty only) per each working day of delay if grant of consent for Establishment (CFE) is delayed for no valid reason.

SITING GUIDELINES
(To accompany Combined Application Form)
  1. No new large/medium/small industries generating effluents and or emissions shall be permitted within the city/municipal limits and residential areas.
  2. No forest land shall be converted into non-forest activity for establishment of industries.
  3. Land acquired shall be sufficiently large to provide for appropriate treatment of wastewater still left for the treatment after maximum possible reuse and recycle. Reclaimed (treated waste) water shall be used to raise green belt and to create water body for aesthetics, recreation and if possible for aquaculture, the green belt shall be sufficiently wide around the boundary limit of the industry. For industry having odour problem, it shall be minimum of 30 mtrs. Wide.
  4. Enough space should be provided for storage of waste, so that the same could be available for possible reuse
  5. No Orange category industry shall be established with in 1.5 Kilometers, from the river banks/streams/lakes/tanks.
  6. No industry shall be established within 500 meters, from national and State highways and railways.
  7. The industries proposed in the coastal areas shall be governed by the coastal regulation Zone rules issued by the Ministry of Environment and forest, government of India.
